These Terms of Service ("Terms") govern your use of AudioRecorder.Net, including the online audio recorder, the online audio editor and the related website. By using the site you agree to these Terms. If you do not agree, please do not use it.

The service

AudioRecorder.Net provides free browser-based tools for recording audio from your microphone and for editing and exporting audio files. The tools run on your device inside your browser. We may change, improve, suspend or remove any feature at any time, with or without notice.

Who may use the site

You must be old enough to form a binding agreement where you live, or have the permission of a parent or guardian. The site is not directed to children under 13. If you use the site on behalf of an organization, you confirm you are authorized to accept these Terms for it.

Your recordings and files

You keep all rights in the audio you record or open. We do not upload your audio, we do not claim any ownership of it, and we do not receive a license to it. You are solely responsible for the audio you create, edit, store and share using the tools and for backing it up.

Recording laws and consent

Laws about recording audio differ by country, state and situation. In many places you must tell people and obtain their consent before recording a conversation, and some places require consent from every person involved. Recording phone calls, meetings, classes, workplaces, minors or private spaces may be restricted.

You are solely responsible for knowing and complying with the laws that apply to you, and for obtaining every consent that is required. We do not provide legal advice and we are not responsible for how you use recordings.

Acceptable use

You agree not to use the site to:

  • Record or share audio in violation of any law, any person’s privacy or any person’s rights, including recording people without a legally required consent.
  • Harass, threaten, defraud, impersonate or harm anyone, or to create unlawful, hateful or sexually exploitative content.
  • Infringe copyright, trademark or other intellectual property rights.
  • Interfere with, overload, scrape, reverse engineer or attempt to gain unauthorized access to the site or its infrastructure.
  • Introduce malware, or bypass or disable security or technical limits.
  • Click on advertisements artificially, or use bots, scripts, automated tools or any other method to generate invalid clicks or impressions on ads shown on the site.

Our intellectual property

The site, its design, text, graphics, code, trademarks and the AudioRecorder.Net name belong to us or our licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, revocable, non-transferable permission to use the site for your personal or internal business use under these Terms. You may not copy, republish, sell or build a competing service from our content or code without our written permission.

Browser storage and loss of data

Saved recordings are kept in your browser storage on your device. They may be lost if you clear browser data, use private browsing, change device or browser, run out of storage, or if the browser removes site data. We cannot access or restore them. You are responsible for downloading and backing up any recording you want to keep.

Advertising and third-party content

The site shows advertising, including ads from Google AdSense, and may link to third-party websites. We do not control and are not responsible for third-party ads, sites, products or services, and showing an ad is not an endorsement. Any dealings with an advertiser are solely between you and the advertiser. See our Privacy Policy and Cookie Policy for how advertising technologies work and how to control them.

Disclaimer of warranties

The site and tools are provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, availability and uninterrupted or error-free operation. Recording and export quality depend on your hardware, browser and settings. See also our Disclaimer.

Limitation of liability

To the fullest extent permitted by law, we and our owners, contributors and partners are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, recordings, profits, revenue, goodwill or business, arising out of or connected with your use of or inability to use the site, even if we were told the damage was possible. Our total liability for any claim relating to the site will not exceed fifty US dollars (USD 50).

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law, or any rights you have as a consumer under mandatory local law.

Indemnification

You agree to defend and indemnify us against claims, damages, losses and costs, including reasonable legal fees, that arise from your misuse of the site, your violation of these Terms or the law, or your recordings and how you use them.

Suspension and termination

We may restrict or end access to the site at any time, including if we reasonably believe you have broken these Terms. Sections that by their nature should continue, such as those on intellectual property, disclaimers, liability and indemnification, will continue after termination.

Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which the operator of AudioRecorder.Net is established, without regard to conflict of law rules. Courts of that jurisdiction have exclusive jurisdiction over disputes, except where mandatory consumer law gives you the right to bring a claim in your own country. Please contact us at contact@audiorecorder.net first so we can try to resolve any issue informally.

Changes to these Terms

We may update these Terms. The "Last updated" date shows when they last changed. If you keep using the site after an update, you accept the updated Terms.
